  • Heywood Realty is the management company for Scene One at 700 W. University in Tempe. When I bought my condo I thought that Marcus Klingler was just a property manager working for the management company, but it seemed strange to me that he would not allow me to talk to the board of directors saying "I know what the board is going to say". After several years I found out that he is one of the 3 directors of the board. Even on the ballot for this year's annual meeting he does not mention his conflict of interest with one single word. Since I bought my condo several years ago I never received a nomination form or anything showing who the members of the board are. Last year, Mr. Klingler would not even send out invitations for the required annual meeting. Usually he does not answer phone calls, it is his assistant, Carmel Schandle, who is supposed to answer all the questions. When I called on 3/19/2018 to find out why I would never get an invitation for the annual meeting or a nomination form for the board of directors, Carmel told me "I don't see that an annual meeting has been scheduled." I called again the next day (3/20) and she told me again that no annual meeting was scheduled I had her on speaker phone and I have several witnesses for this conversation. I asked her when the annual meeting took place last year (in 2017) and she told me "I don't know but I will find out". I called again the next day, on 3/21/2018 around 10 am and another lady with the name Leslie answered. She told me "Carmel is working on it, you will receive an answer later this afternoon." Several hours later I received an email from Carmel saying "the annual meeting is set for Wednesday, April, 4th (...) I did confirm that the mailer was sent to our processing center on Monday (...)" I received the invitation for the annual meeting a week later, it was dated 3/19/2018 and postmarked 03/21/2018. Very strange, that Mr. Klinger's assistant who is in charge of Scene one was not able to tell me that the meeting had already been scheduled and that she was not able to ask Mr. Klingler if he is the only one with this information. What was even stranger than the fact that Mr. Klingler completely skipped the required annual meeting / board elections in 2017 and then apparently mails out the invitations in a hurry after a member keeps calling for 3 days, was that I did not receive a nomination form prior to receiving a ballot. The ballot had 4 names on it only one candidate is not a current board member. As the property manager, Mr. Klingler is in control of scheduling annual meetings or not to schedule them, of mailing out nomination forms or not to mail them out, it is the kind of democracy for which countries like North Korea are famous.
