  • This review is on behalf of my parents, straight from the formal complaint they filed that I encouraged them to share here to warn others. I have posted this review on the other location concerned with this matter on Green Valley Parkway, and this Dean Martin location is their HQ/Corporate Office which we have been also heavily dealing with: My wife and I purchased a Simmons mattress on the 22nd of May including the box spring from the 615 S. Green Valley Parkway location and was sold a mattress by Melissa. We paid the $50 delivery fee and it was delivered the next day around 3pm. Both the box springs and mattress were wrapped, and the delivery men asked us if they'd like for them unwrap it to which we said yes for just the mattress. They finished setting up mattress in one of our bedrooms and had us sign that it was delivered. It wasn't until an hour or so later that I began to put bedding and sheets that I noticed the large tear/hole. I immediately called Melissa the representative and was given an email to send over my concern and that one of her regional directors will contact us. He did and told us that he would send a driver over after Memorial Day weekend to look at it. When the inspector/driver got here on May 31st, he took pictures and inspected it and said they will be in touch. A week had passed and no one contacted us so we had to all Melissa again. She said she does not know what was going on so she will have her Director contact us. When he did last week (the week of June 13th) , he said they cannot do anything about it. To our agreement upon the purchase of the mattress there is a year warranty and they refused to take any actions over our concern. We told the Director that it is not okay and we would be taking further action. He then claimed that he would speak to the owner of Best Mattress to see what they can do. We never heard from them again. Today we received a letter in the mail dated June 17, 2016 in which they state that the damage "cannot be attributed to the delivery process considering the loss of fabric and material that has occurred in the product." How is it possible to lose so much of the fabric and material when I called them to express my concerns of the damage upon an hour of delivery? It seems as if the delivery men gripped the mattress too rough and deep. They attached the photos the inspector took of the mattress as well and the signed delivery ticket (which was just a copy of our receipt). The receipt states (both ours and their signed copy) that we should "present this receipt for warranty." The letter in full reads: "Dear (name), Enclosed please find a copy of the Simmons Limited warranty for your bed set. The Simmons Limited Warranty covers manufacturer defects in workmanship and materials. When the product failure is caused by factors other than defective workmanship or materials the warranty is invalidated. All other claims including incidental or consequential damages are precluded. The damage to your mattress was caused by factors other than workmanship and invalidates your warranty. The inspector did note measurements of the aperture and cavity in your mattress. These cannot be attributed to the delivery process considering the loss of fabric and material that has occurred in the product. Please note the cost of inspection is not covered under the terms of the Simmons Manufacturer Warranty. This inspection was done at no charge as a courtesy. We regret we can no longer be of assistance to you. Best Mattress does not offer a warranty of any kind on your mattress set, neither expressed or implied. Your product is warranted by the manufacturer only. Sincerely, Best Mattress Customer Service." They also attached a copy of the Simmons warranty and HIGHLIGHTED that "***SIMMONS SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF YOUR SIMMONS PRODUCT***" And again, we never used the product! We got it in within the hour when we found the hole. WE DID NOT DAMAGE THE PRODUCT AND IT WAS NOT DEFECTED. It was negligence by Best Mattress and they are not taking responsibility. We will continue to pursue this matter even further until resolved. Note: All my parents want is a replacement, it's disgusting how Best Mattress is handling this matter.
