  • After having two kids we could no longer reside in our 1170' condo and decided to purchase another home last September with the intentions of selling our condo that is currently being managed by First Service. However at the end of September we received a letter that stated our building was going to be undergoing construction for the next 4-6 months. With this new information, our realtor explained that until the construction was over we most likely would not be able to sell our property without taking an enormous hit. Come to find the letter was sent to us in error and was in regards to another building (not ours at all). After many phone calls, emails, etc to which went unresponded, we FINALLY received an email that stated our building was not undergoing construction and was sent in error. Our realtor then acknowledged that since it was the holidays we would have to wait until after due to not wanting our listing to sit and cause a decrease again in the amount for which it could be sold. So we allowed friends, family to stay while we waited for the new year. On Jan 18th, We received a letter advising that they felt we may be renting our property. Two days later, we received another letter regarding a hearing in front of the board on Jan 21. All of this within two weeks from the date of the original letter. As governed in our actual doctrine it states that we are given 10 days to correct a problem prior to any action being taken. We quit allowing friends/family to stay immediately fixing the problem and now are still being charged despite the rules in the governing documents to state having a process that has to be consistently adopted for all these processes. We immediately placed our home up for sale, found a buyer and two days later found that we have a $8500 assessment that could be owner's responsibility or an increase of HOA fees over the course of 10 years being determined by a vote due March 15th. The buyers immediately backed out and we are in limbo waiting to see how the assessment is going to be applied. In the meantime our listing sits now collecting time being up for sale. The more time that no one purchases the decrease of it's value. I feel that both parties are responsible here. One our community HOA that didn't do their due diligence to find a more responsible property management team and two First Service Residential who is not even educated enough on the community's governing rules and regulations that are now going to fine us without complying with them. Should we not pay, they threatened to place a lien against our condo. Should a lien exist against your property prior to selling, it must be paid or else the sale will not be allowed to move forward. These HOA's and property management teams are now gaining way too much responsibility and the homeowners are at a huge loss if they do not have an HOA and community management team that is really there to ensure quality care of both the community and it's homes.
