| - The pool pump motor at the Swenson Street Apartments 3850 Daisy St., Las Vegas, NV 89119 has gone bad and had an excessive high whine noise for the past 7 days. Swenson St. Apt. Manager has been aware of problem. Many have complained, including myself. Motor whines so loud 24 hours a day for the past seven days and nights it has interfered with my sleep annoying me causing unnecessary stress and issues including, but not limited to having a bad attitude and be short with people because of it. Las Vegas Municipal Code, Chapter 9.16 per Definitions Chapter 9.16.005 Definitions paragraph (F) states: "Noise disturbance" means any sound which is unreasonably loud, disturbing or unnecessary or which endangers or injures the health of humans or annoys or disturbs a reasonable person of normal sensitivities. Chapter 12 further provides:12.28.050 - Penalty for violation. Whoever violates any provision of this chapter or any provision of a proclamation issued pursuant to this chapter shall be deemed guilty of a misdemeanor. Sgt. Colectco (sp?) stated that Las Vegas Metro will not investigate a Noise Ordinance Violation and write a citation if an offense had been committed. Refusing to investigate an excessive noise ordinance complaint violation and upholding the ordinances of the City of Las Vegas, County of Clark, and laws of the State of Nevada is his sworn duty to do. His statement refusing to do so is an admission of a knowing, willful and intentional omission of duty of office. If an officer knowingly and willfully refuses to perform the duties of his office, he should not have an office. If he isn't going to do his job, he shouldn't have one. Selective enforcement doesn't cut it. Had I been a city councilman etc. and called about this, my treatment would have been different as well as the outcome. Now I get to continue to put up with this excessive noise because Las Vegas Metro refuses to uphold the law.
