We built and moved into our house a few years ago. The house was built by Mattamy Homes and it is in the Marley Park Home Owners Association.
When we were doing the final walk through before we signed the paperwork to close on the house, we noticed that the concrete border around the front yard was cracked in multiple places. We asked the man doing the walk through with us from Mattamy who told us that it was no problem and they would take care of it. He added it onto the list and said he would take care of that along with other issues (paint and such) in the next couple weeks. He fixed everything else in the coming month, but he didn't fix the cracked border. He told us several times that he would take care of it and then he said that it was an HOA issue, but he would contact them and get it done. I gave him the benefit of the doubt and waited and since they had fixed everything else.
Fast forward a couple months and I contacted him again and he had left the company. The new contact from Mattamy said that he saw it on the walk through form and he would take care of it. I also contacted the Marley Park HOA and they said they would look into it. Over the following couple years, I have had several new repair people from Mattamy tell me that they can take care of it and it'll be easy and then they never fix it. The HOA has said that it is ok private property and refuse to fix it.
Now, Marley Park HOA says it is not their fault, on private property and refuses to help. Mattamy says that they think that the HOA must have broken it when they were landscaping and so it isn't their problem either. They also said that it is too late now because the warranty expired even though I have literally asked since before I even owned the house.
I am very frustrated as it happened before I bought the house and certainly was not caused by something I did. The two groups that could have caused it have been very hard to reach and Mattamy has made promises and then not followed through.
My advice to anyone planning to build with them or to build in this neighborhood it this:
Don't sign the paperwork until ALL repairs are fully done. If you have taken on responsibility for the house, you'll be on your own. Best of luck.
