  • I would like to update my review to let everyone know what has transpired since all of this began. - July 22: My apartment unit 521 flooded, water was coming up from the floorboards. Emergency maintenance was called. - July 25: Mold was confirmed, and was actively growing in areas that suffered water damage from the flooding AC Unit. Remediation could not begin until July 27, so I was advised to get the things I would need until August 3. After much back and forth, a rental credit was finally supposed to be provided for these days that I was homeless; I have this confirmation in a letter from the apartment's lawyer. - July 27: I stopped by the unit and two maintenance men (NOT mold re-mediators) were working on the plumbing in the dark, with flashlights (likely so they didn't electrocute themselves). Counters were ripped out and my furniture, dishes, food items, etc. were all thrown into the living room area. I could not assess any damages at this point because everything was blocked off by plastic tarp that was stapled to the wall, not completely sealed off. - July 29: I had not heard back from Lynne at the office after several messages and sought legal advice. I sent a letter via certified mail stating that I was legally terminating my lease under the AZ Landlord Tenant Act. - August 2: I received a reply confirming that the lease had been broken and a rental credit to be issued from their attorney. - August 3: The remediation was supposed to be completed; it was not. - August 5: Remediation is still not complete; in fact, no work had been done since July 27. I went to the office and told Lynne I was removing all of my personal items, none of which had been treated for mold. She accompanied my mother and I, along with a maintenance man. Upon entering, the maintenance man proceeded to rip down all of the plastic covering from the unit per Lynne's direction. Counters, cabinets, sinks, flooring, drywall, etc. were not present in the kitchen, bathroom, or bedroom. My dining room table had a cracked leg from the maintenance people moving it, along with a chemical stain on the top. Additionally, when the pantry area was emptied, the maintenance people threw all my food items into a plastic bag on the kitchen floor, breaking glass and spilling olive oil all over my food, which had to be discarded. I pointed all of this out to Lynne, who stated, "What's wrong with it?" as if everything were fine. I have this on video. - August 8: The office closed at 5 pm the previous Friday, so I mailed my keys back certified mail, awaiting a response regarding my refund for over payment of rent. - August 16: Upon receiving no response, another letter was sent, certified mail of course, asking for the return of my money. Again, no response. - September 6: I sent an email to Lynne asking the status of my refund check. No response. - September 8: I filed my lawsuit against the property owner for my damages, plus court costs, filing fees, and interest at the legal rate until the judgement is paid. A copy was sent to the owner via certified mail. - September 12: I received a call and an email from Lynne, to which I responded via email. Miraculously, she received this email but not my previous emails or letters requesting the status of my refund check. - September 13: The law firm sent me written correspondence of a negotiated settlement, less than the amount I was suing for. I agreed because I wanted this all to be over. - September 20: I finally received a written letter from their attorney asking me to sign, which included a tiny line asking me to remove my online reviews. I declined, unwilling to remove my review and pissed off because I felt the letter was manipulative, and somewhat sneaky to put in a single line about removing social media posts in the entire document. This is not a fact, but I believe that they thought I wouldn't read the letter in its entirety and would sign the agreement, which would result in them demanding that I remove my review before releasing payment. - September 21: I submitted a (very well written, if I do say so myself) letter to their attorney rescinding my acceptance. I told them to revisit and revise their settlement or to file a response with the court and to have a judge settle the matter. They revised the settlement to a higher amount and removed the statement requiring me to remove my online postings. - Sept 22: I signed and sent the settlement agreement. I picked up my check and am finally done with all of this nonsense. I sent a letter to the owner and their attorney stating that I had withdrawn my lawsuit from the court system. *This is my account of the incidence that occurred while dealing with this property. No part of this review has been, or ever will be, dictated by the settlement claim. Please spare yourself the trouble that you will undoubtedly encounter if you ever decide to move here.
