Recently purchased a short sale and our realtor used National Title. What a mistake. Obviously we purchased title insurance since short sales can be so iffy sometimes. Well when it came time to disburse the funds they didn't pay off the garbage company lien. Complete incompetence if you ask me! Now we can't start up our new service with the garbage company until this is resolved (and we're getting farther behind every month that goes by). When notified of the error, they offered to pay half and we pay half rather than file a claim with their insurance company (or just pay it themselves to avoid a claim!). If we don't accept that, we were told we could get a lawyer, but that we'd signed the paperwork so it was OUR fault. Um, yea...the paperwork that YOU prepared for us to sign. If you omitted the garbage lien from those documents, then you should be willing to fix your mistake...it's what you do...research and prepare title documents! WHAT!? I already paid over a $1000 for title insurance!!! For just this kind of circumstance. Well, the jokes on them--we'll take their half and pay ours, but then we'll be filing with the state agency that oversees/regulates title companies. Not to mention letting others know to avoid dealing with them, or at the very least to check and double check that all the liens were listed to be paid off in escrow. If you're an agent that uses them...maybe think twice about that too. Even our realtor couldn't get them to do the right thing for us. Shameful!
