| - As with most Americans, our family has been diligently working towards a financial recovery since the crash of 2008. After losing almost everything we have been making a lot of progress on that mission with debt settlement, new home ownership and a savings account again! Recovering American families like ours with hard work and sacrifice have been able to put ourselves back on a positive track with the possibility of providing a safe and comfortable future for our families, not to mention the opportunity to contribute to the regrowth of our nation's economy. Then out of nowhere comes an opportunistic collection agency that bought an old credit card debt that had been officially written off by the original creditor years ago. Mind you, this was debt that had been created by my former employer (a genuine con man) that had since served a prison term for white collar crimes.
This collection agency made it their mission to hunt me down, send their goons to my home and pound on my door at dinner time and embarrass me at my place of employment by telling my co-workers that they needed to talk to me to serve me. They claimed that I owed them over $20,000.00 and were going to take me to Superior Court. After many, many failed attempts to serve me in the traditional manner (personally handing me a summons) they resorted to mailing me a summons to my place of employment. That constituted an official serve! How is that even legal? Naturally I was quite concerned about the tenacity of this collection agency, the amount they were trying to extort from me and the fact that this was a Superior Court matter so I new I needed legal representation to give me and my family a fighting chance. After an initial conference with John Skiba, I knew we had the right firm on our side. His calming demeanor, clear and concise explanation of the situation and processes and his extensive knowledge of the legal system and our rights immediately put us at ease.
After retaining John's services we supplied him with all of the pertinent information and documentation he needed to prepare our defense. In the meantime the collection agency declined our offer to settle out of court to make this whole thing go away and let us get on with life. Not only did they decline a settlement offer, they tacked on a ridiculous amount of fabricated interest penalties to increase the debt to over $40,000.00! Who are these greedy people?
Waiting for our case to make its way through the bogged down court system seemed like an eternity as our emotions were out of control but eventually our case made it to a Superior Court judge. John was very well prepared and confident with his representation of our case. The collection agency was unable to present a lot of the requested documentation from John Skiba which compromised the validity of the plaintiff's claims. A week later the judge, after a preponderance of the evidence ruled in our favor. In Superior Court it's an all or nothing ruling. In other words there is no settlement amount or compromise. A ruling in our favor means we owe the plaintiff nothing and we are entitled to recover our attorney fees and court costs from the plaintiff! Poetic justice!Words cannot express how impressed we are with John's professionalism and experience in protecting innocent people from the shady predators out there who take advantage of recovering American families.
